USCIS Expands Premium Processing, Effective January 30

As of January 30, 2023, individuals can submit premium processing requests for any new or currently pending Form I-140, Immigrant Petition for Alien Workers filed for non-citizens here in the United States on a broad range of work visas. Who qualifies for premium processing requests?

If you’re looking to file a Form I-140, Immigrant Petition for Alien Workers, for an E13 multinational executive or manager, an E21 member of professions with advanced degrees or exceptional ability seeking a National Interest Waiver (NIW), you should qualify for premium processing. The expansion comes as an effort on the part of USCIS to make premium processing available for more EB-1 and EB-2 classifications.

It is also worth noting that USCIS plans to expand premium processing in the coming months for additional parties, including certain F-1 students, certain students and exchange visitors with a pending Form I-539, Application to Extend/Change Nonimmigrant Status, and for certain students and exchange visitors looking to file initial Form I-539 applications.

How do I request it?

If you’re looking to request premium processing either on or after January 30, 2023, you will have to file the new edition of Form I-901, Request for Premium Processing Service. This edition should be dated November 3, 2022, as USCIS is no longer accepting the former edition of Form I-901. You must also submit a separate filing fee with your request for premium processing. If you submit a combined fee payment, the filing will be rejected.
