What is a TN Visa?

As previously mentioned, TN Visas are nonimmigrant employment visas available to citizens of Canada. Typically, Canadian citizens do not need a NAFTA professional (TN) visa to gain entry into the United States. But if the participant wishes to bring dependents, i.e. spouses and unmarried children under the age of 21, to the U.S., the participant must have a TN visa. The dependents are then eligible to receive a TD nonimmigrant visa.

How do you qualify for a TN Visa?

The participant must provide the following documentation to U.S. immigration officials:

  • Proof of Canadian citizenship
  • Letter from your prospective employer detailing items such as the professional capacity in which you will be working, the purpose of your employment, your length of stay and your educational qualifications
  • Credentials evaluations, if applicable, together with any applicable fees

Once obtained, this special visa can be used for the following 60 occupations:

What are the benefits of TN Visas?

One of the main advantages of TN Visa status is that one can obtain it quickly. Since no petition is required for Canadians, and the visa may be obtained directly at the border, there is no long wait for one’s immigration status to be approved. It is also relatively inexpensive and can be indefinitely renewed for three-year periods.

Despite this comparative ease, you would be wise to reach out to an attorney skilled in employment immigration if you face any difficulty or would like more information.
