On December 10, 2024, U.S. Citizenship and Immigration Services (USCIS) introduced a revised edition of Form I-485, Application to Register Permanent Residence or Adjust Status. This updated version, effective February 10, 2025, includes several critical changes designed to simplify the application process and reduce confusion for applicants. Read this blog and reach out to a New York City immigration lawyer from the Lightman Law Firm to learn more about these updates and how they may impact you. Here are some of the questions you may have:

Why Did USCIS Revise Form I-485?

USCIS has implemented these changes as part of an ongoing effort to make the immigration process more efficient and user-friendly. By updating the form and its instructions, the agency aims to simplify how applicants provide required information and reduce the likelihood of errors or omissions that could delay case processing.

What Are the Key Changes to Form I-485?

The new edition of Form I-485 includes several significant updates that applicants need to be aware of. These are as follows:

  • Submission of Form I-693 with Form I-485: Applicants who are required to submit Form I-693, Report of Immigration Medical Examination and Vaccination Record, must now include it along with their Form I-485. This applies whether submitting the full Form I-693 or only a partial version, such as a vaccination record. Failure to include Form I-693 when it is required may result in the rejection of your Form I-485 application.
  • Elimination of Form I-864W: USCIS has discontinued Form I-864W, Request for Exemption for Intending Immigrant’s Affidavit of Support. Applicants who qualify for an exemption from the Form I-864, Affidavit of Support, requirement can now request this exemption directly on the updated Form I-485. This change eliminates the need for a separate form, streamlining the process for individuals exempt from financial sponsorship requirements.
  • Clarification of Public Charge Questions: The updated form includes clearer questions about the public charge ground of inadmissibility. Applicants are now required to identify their immigrant category, which will help USCIS determine exemptions more efficiently and reduce misunderstandings about this critical aspect of admissibility.
  • Simplified Instructions: The revised form consolidates and clarifies the instructions and requirements, making it easier for applicants to understand what is expected.

When Will USCIS Begin Accepting the New Form?

Starting February 10, 2025, USCIS will only accept the 10/24/24 edition of Form I-485. Any older editions of the form submitted after this date will be rejected. Applicants should ensure they are using the correct version to avoid delays or complications.
