The Department of Homeland Security (DHS) recently announced that Lebanon has been designated for Temporary Protected Status (TPS) for an 18-month period. This decision, made by Secretary of Homeland Security Alejandro N. Mayorkas on October 17, 2024, reflects ongoing challenges in Lebanon that prevent nationals from safely returning to their country. Read this blog and reach out to a New York City immigration lawyer from the Lightman Law Firm to learn about what this means for eligible Lebanese nationals and how to apply.

What is Temporary Protected Status (TPS), and Why Was Lebanon Designated?

Temporary Protected Status is a humanitarian program that allows nationals of certain countries facing extreme conditions, such as armed conflict or environmental disasters, to reside and work in the United States temporarily. Lebanon’s designation recognizes the severe circumstances affecting the country, providing eligible individuals relief from deportation and access to work authorization in the U.S.

The designation specifically applies to Lebanese nationals (or individuals without nationality who last resided in Lebanon) who have been continuously living in the United States since October 16, 2024, and physically present since November 27, 2024.

Who Is Eligible for TPS Under This Designation?

To qualify for TPS under this new designation, individuals must meet the following criteria:

  • Continuous Residence: Must have continuously resided in the U.S. since October 16, 2024.
  • Continuous Physical Presence: Must have been physically present in the U.S. since November 27, 2024.
  • Application Period: Submit Form I-821, Application for Temporary Protected Status, between November 27, 2024, and May 27, 2026.

Applicants can also apply for related benefits, including:

  • Employment Authorization Document (EAD): Submit Form I-765 with your TPS application or separately at a later time.
  • Travel Authorization: Available to those granted TPS.

Lebanese nationals covered under President Biden’s July 26, 2024, grant of Deferred Enforced Departure (DED) are also eligible to apply for Employment Authorization Documents. These DED-based EADs will remain valid through January 25, 2026.

How to Apply for TPS and Related Benefits

To apply for TPS, individuals must:

  • Complete and submit Form I-821 during the initial registration period.
  • If seeking work authorization, file Form I-765 alongside the TPS application or later.
  • Follow all instructions outlined in the Federal Register notice to ensure eligibility and compliance.

For F-1 students or DED-related inquiries, specific guidelines and forms are available on the USCIS website.
