What is PERM Labor Certification?
The Program Electronic Review Management method is the process by which foreign nationals can get a green card through employment here in the United States. Essentially, this is a streamlined, internet-based process that will give a person the right to live and work in the U.S.
To gain an employment-based green card through this process, an employee will need to apply for a job for which they are qualified, but there are not enough American citizens able, willing, qualified, and available to perform.
The primary purpose of this program is to speed up the process of allowing foreign nationals to work in certain fields of employment without impacting American workers and their wages.
How can I gain employment in the United States through this program?
First, a prospective employer will have to file a Prevailing Wage Determination Request form with the U.S. Department of Labor. From there, the DOL will determine a fair wage based on the job description. Finally, the employer will get the labor certification, file Form I-140 with USCIS, and the prospective employee may then file for an adjustment of status application.
How long does the process usually take?
Typically, the labor certification process takes anywhere between 45-60 days. That said, there are some cases where the Department of Labor will have to conduct an audit, which may extend the duration of the process.
